I, Urška Gabrič, a micro-entrepreneur in France, registered under SIRET number: 83464175500014, with business address at 48 R Volta, 75003 Paris, am the owner of the Mindful Glow and data controller responsible for your Data.

What this policy governs

This Privacy Policy governs Data and non-personal data which we collect from you when you use Mindful Glow. We collect and manage your Data so we can provide you with the services available throughout Mindful Glow. By using it, you agree to the terms of this Privacy Policy. Definitions

“Personal Data (or Data)”: Any information that directly, indirectly, or in connection with other information — including a personal identification number, such as user ID number, provided by some services — allows for the identification or identifiability of a natural person.

“Usage Data”: Information collected automatically through Mindful Glow (or third-party services employed therein), which may include: the IP addresses or domain names of the computers utilized by you, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by you, the various time details per visit (e.g., the time spent on each page within the Mindful Glow) and the details about the path followed within the Mindful Glow with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the IT environment.

“You”: The individual using Mindful Glow who, unless otherwise specified, coincides with the Data Subject.

“Data Controller (or Controller)”: The natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of Data, including the security measures concerning the operation and use of Mindful Glow. The Data Controller, unless otherwise specified, is the owner of this Mindful Glow.

“Data Processor (or Processor)”: The natural or legal person, public authority, agency, or other body which processes Data on behalf of the Data Controller, as described in this Privacy Policy.

Types of data collected

Among the types of Data that Mindful Glow collects, by itself or through third parties, there are:

(a) Identity Data: first name, last name, Instagram handle, Facebook handle, birth date, nationality.

(b) Contact Data: e-mail address, phone number, billing address.

(c) Health Data: information on your health to the extent and type that you voluntarily provide us.

(d) Financial Data: bank account, payment card details.

(e) Technical Data: details about payments from you, internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this Mindful Glow.

(f) Usage Data: information about how you use Mindful Glow, products, and services.

(g) Geographic Data: Includes your location.

Where we need to collect Data by law, or under the terms of a contract we have with you, and you fail to provide that Data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with a coaching program). In this case, we may have to cancel or restrict your use of Mindful Glow or the service you have with us, but we will notify you if this is the case at the time.

Mode of collecting data

We use different methods to collect Data from and about you including through:

(h) Direct interactions: You may give us your Data by filling in forms on the webpage or by corresponding with us by email or otherwise.

(i) Automated technologies or interactions: As you interact with Mindful Glow, we will automatically collect technical data about your equipment, browsing actions, and patterns. We collect this Data by using cookies and other similar technologies.

Legal basis

We may process Data relating to you if one of the following applies:

(j) you have given us your consent for one or more specific purposes;

(k) provision of Data is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof;

Where does processing take place

The Data is processed at our operating office and in any other places where the parties involved in the processing are located. Depending on your location, data transfers may involve transferring your Data to a country other than your own. The Purpose of processing

The Data concerning you is collected to allow us to provide our services, comply with our legal obligations, respond to enforcement requests, protect our rights and interests (or those of my users or third parties), detect any malicious or fraudulent activity, as well as when you:

(i) sign up for newsletter;
(ii) download a Freebie;
(iii) book a discovery call;
(iv) book 1:1 90 minutes consultation or 12 weeks health coaching;
(v) buy a group course or a webinar;
(vi) give us feedback or contact me.

We will only use your Data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. If we need to use your Data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

How long I hold Your data

Your Data is processed and stored for as long as required by the purpose it has been collected for. Therefore:

(a) Data collected for purposes related to the performance of a contract between you and us shall be retained until such contract has been fully performed.

(b) Data collected for the purposes of our legitimate interests shall be retained as long as needed to fulfil such purposes.

(c) We may be allowed to retain Data for a longer period whenever you have given consent to such processing, as long as such consent is not withdrawn. Furthermore, we may be obliged to retain Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Data will be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

Reliability. You are responsible for backing up, to your own computer or other devices, any important data stored or accessed via Mindful Glow. We do not guarantee or warrant that any content you may store or access through the Mindful Glow will not be subject to inadvertent damage, corruption, or loss.

Security. We will use commercially reasonable efforts to safeguard the confidentiality of your Data. However, we cannot be held liable for any loss of or disclosure of Data or any losses or damages incurred due to errors in transmission or unauthorized or unlawful acts of third parties or your decision to disclose your Data. No system can be 100% secure, and despite our efforts, there is always a risk of unauthorized access to your Data. By using Mindful Glow and its services, you assume this risk.
